Activist Michigan Supreme Court justice bends law to favor auto insurance companies in fraud cases

Michigan law just got uglier, thanks to Supreme Court Justice Stephen J. Markman, and Michigan’s Republican majority. In a series of fraud case rulings, including the recent decision by Markman & Company in Titan Insurance Company v. Hyten, at al., these activist Justices have now changed the rules for proving fraud in this state.
It seems to this writer that the only criteria for this double standard is who is claiming the fraud and who is defending against it.
It sadly comes as no surprise to Michigan personal injury lawyers, law professors, and judges in this state as to who wins and who loses under this Court.
When an auto insurance company is accused of fraud by one of its insureds, Markman & Company raised the bar for proving fraud.
But, when it is the auto insurance company accusing one of its insureds of fraud, the activist, Republican justices lowered the bar.

Law and Ordinance Coverage C Limits of Coverage—How Much to Obtain?

Law and Ordinance Coverage (often referred to as “Code Upgrade Coverage”) can be extremely complicated for those involved in any aspect of property insurance coverage. From a policyholder’s standpoint, Law and Ordinance Coverage is a counterintuitive riddle.
It is nearly impossible for policyholders to participate in a meaningful way in the determination of how much Law and Ordinance Coverage C should be obtained. I have always thought it is unfair that most policyholders purchase Replacement Cost insurance, which typically excludes the increased costs of repair due to compliance with building laws and ordinances.
My reasoning is twofold:

Telematics insurance sales rise by 25%

There has been a 25% rise in telematics-based car insurance, according to price comparison website Tiger.co.uk.
Younger drivers often find it hard to find affordable car insurance, but telematics car insurance is proving popular, with a 25% rise in sales made through Tiger.co.uk in the first four months of 2012.
Telematics involves the use of a black box to record driving behaviour, and enables motorists who drive more safely to be rewarded with lower premiums.
The Co-operative Insurance reported earlier this year that its own telematics insurance cut crashes by 20%, as drivers seek to be safer to save themselves money.
The savings, especially for younger drivers, can be significant, and women drivers can benefit in particular as gender has been axed as a risk category but women drivers tend to be safer.
Therefore, women opting for telematics will not receive a lower premium based on their gender, but will if they drive more safely.
